Sharing of e-paper PDF….. a Copyright breach
The Newspaper industry, during recent times highlighted the plight of forwarding the “e-newspapers” in PDF format thru social media. Such downloads are not only ethical, but illegal too. The recent Delhi High Court judgement has held that copying e-papers causes irreparable loss, and ordered that unauthorized dissemination be stopped.
Newspapers, being the Copyright owners of the e-papers, it’s contents and any attempt to circulate or copy the same on social media is the violation of the Copyright Act. Their concern is also shared in view of the news papers may be doctored by introducing fake news and creating legal troubles.
Under the meaning of Copyright (Section 14, Copyright Act, 1957), the exclusive right ,subject to the provision of this Act, to do or authorize the doing of any of the acts in respect of a work or any substantial part thereof” …. The act gives the newspaper the exclusive right to reproduce and store the work and every other user who is downloading the newspaper or enabling it is infringement of the law.
The piracy of the newspaper has also come under the criticism from the Indian Newspaper Society(INS). Senior Supreme Court lawyer has also criticized such practices and called it as a breach of Copyright Act as well as the Information Technology Act.
